These Terms of Service (“Terms”) govern access to and use of Smart Time Nova, a service provided by NovaCore Prime Inc. By creating an account or using Smart Time Nova, you agree to these Terms.
1. Service
Smart Time Nova provides workforce time tracking, company/workspace access, work logs, reporting and related operational tools. Features may change as the product evolves.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for activity performed through your account. You must provide accurate information and use the service in compliance with applicable law.
3. Company and Workplace Use
Organizations using Smart Time Nova are responsible for configuring workforce policies, user roles, attendance requirements and data collection practices in accordance with applicable employment, privacy and workplace laws.
4. Acceptable Use
You may not misuse Smart Time Nova, attempt unauthorized access, interfere with service operation, upload unlawful content, or use the service in a manner that infringes the rights of others.
5. Subscriptions and In-App Purchases
Some Smart Time Nova features may require a paid subscription. On Apple platforms, eligible subscriptions may be offered through Apple’s In-App Purchase system. Prices, billing periods, renewal terms and cancellation options are displayed before purchase. Apple-managed subscriptions can be managed through the user’s Apple ID subscription settings.
6. Availability and Changes
We may update, modify, suspend or discontinue features when reasonably necessary for product development, security, maintenance or legal compliance. We do not guarantee uninterrupted availability.
7. Customer Data
Users and organizations remain responsible for the accuracy and lawful use of information they enter into Smart Time Nova. Our handling of personal information is described in the Privacy Policy.
8. Intellectual Property
Smart Time Nova, the NovaCore Prime name, software, design, documentation and related materials are owned by NovaCore Prime Inc. or its licensors and are protected by applicable intellectual property laws.
9. Disclaimer
To the maximum extent permitted by law, Smart Time Nova is provided on an “as available” basis. The service is a workforce operations tool and is not legal, accounting, payroll, tax or employment-law advice.
10. Limitation of Liability
To the maximum extent permitted by applicable law, NovaCore Prime Inc. will not be liable for indirect, incidental, special, consequential or punitive damages arising from use of or inability to use the service.
11. Termination and Account Deletion
You may stop using Smart Time Nova at any time and may initiate account deletion using the available account controls. We may restrict or terminate access where reasonably necessary for security, legal compliance, non-payment or material violation of these Terms.
12. Governing Law
These Terms are governed by the laws applicable in Ontario, Canada, without regard to conflict-of-law principles, subject to any mandatory consumer protections that apply to you.
